Ch. 6                                            1994 LAWS OF MARYLAND

A MEMBER MAY PURCHASE SERVICE CREDIT AS PROVIDED IN SUBSECTION (B)
OF THIS SECTION FOR PERIODS OF EMPLOYMENT FOR WHICH THE MEMBER:

(1)      WOULD HAVE BEEN ENTITLED TO PURCHASE SERVICE CREDIT
UNDER THE EMPLOYEES' RETIREMENT SYSTEM; AND

(2)      IS NOT OTHERWISE ENTITLED TO SERVICE CREDIT UNDER THE
CORRECTIONAL OFFICERS' RETIREMENT SYSTEM.

(B) PAYMENT FOR SERVICE CREDIT.

(1)      A MEMBER WHO PURCHASES SERVICE CREDIT UNDER THIS SECTION
SHALL:                                                                                                            

(I)       COMPLETE A CLAIM FOR THE SERVICE CREDIT AND FILE IT
WITH THE BOARD OF TRUSTEES ON A FORM THAT THE BOARD. OF TRUSTEES
PROVIDES; AND

(II)     PAY TO THE BOARD OF TRUSTEES IN A SINGLE PAYMENT THE
MEMBER CONTRIBUTIONS THE MEMBER WOULD HAVE MADE FOR THE PERIOD OF
EMPLOYMENT FOR WHICH SERVICE CREDIT IS BEING PURCHASED PLUS REGULAR
INTEREST TO THE DATE OF PAYMENT.

(2)      A MEMBER MAY PAY FOR SERVICE CREDIT PURCHASED UNDER
THIS SECTION AT ANY TIME BEFORE RETIREMENT.

REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 73B, § 7-303.

In subsection (a) of this section, the reference to "periods of employment for
which the member" is entitled to purchase service credit is substituted for the
former list of types of employment under Art. 73B, § 7-303(a) and (c) because
the State Personnel and Pensions Article Review Committee determined that
those specific categories are unlikely to apply to any member of the
Correctional Officers' Retirement System and that a general approach would
be more appropriate.

In subsection (b)(l)(i) of this section, the reference to "complet[ing] a claim
for the service credit and fil[ing] it" with the Board of Trustees "on a form
that the Board of Trustees provides" is added to state expressly that which
formerly only was implied — i.e., a completed claim must be filed for the
service credit.

In subsection (b)(1)(ii) of this section, the reference to payment to "the Board
of Trustees" is added to clarify to whom the payment is to be made.
