1994 LAWS OF MARYLAND

A MEMBER IS ENTITLED TO RECEIVE 1 MONTH OF SERVICE CREDIT FOR
EMPLOYMENT FOR A MONTH OR A PART OF A MONTH IF A MEMBER CONTRIBUTION
IS MADE IN THAT MONTH.

REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 73B, § 7-301(b)(1), (2), and (3) and the first
sentence of (4)(i).

In this section, the term "service credit" is substituted for "creditable service"
because in this Division II "service credit" is the basic unit of both "eligibility
service" and "creditable service".

In subsection (a) of this section, the phrase "[s]ubject to subsections (b) and
(c) of this section" is added to clarify that the Board's regulations must meet
the requirements set out in this section.

Also in subsection (a) of this section, the reference to a "period of
employment" is substituted for the former reference to "how much creditable
service" for clarity.                         

In subsection (b) of this section, the reference to the "Board of Trustees" is
added to clarify that the limitation applies to the Board.

In subsection (c) of this section, the former rule for computing service credit,
which stated that employment "for the full normal working time" for a year
equals "1 year's service" is deleted as unnecessary. Subsection (c) states the
rule for computing service credit in terms of employment for "a month or a
part of a month"; therefore, an additional rule for yearly employment is
unnecessary.

Also in subsection (c) of this section, the former rule for computing "regular
part-time employment" is deleted as unnecessary. Under subsection (c) of this
section, a member receives service credit for employment during any month in
which "a member contribution is made" regardless of the member's work
schedule. In any case, the Department of Public Safety and Correctional
Services reports that it does not hire part-time correctional officers.

ELIGIBILITY SERVICE FOR A MEMBER CONSISTS OF SERVICE CREDIT:

(1)      FOR EMPLOYMENT AS A MEMBER;

(2)      REGAINED UNDER § 25-304 OF THIS SUBTITLE BY A MEMBER WHO
REDEPOSITS ACCUMULATED CONTRIBUTIONS PREVIOUSLY WITHDRAWN;

(3)      TRANSFERRED FROM A RETIREMENT OR PENSION SYSTEM UNDER
TITLE 37 OF THIS ARTICLE OR TITLE 31, SUBTITLE 1 OF THIS ARTICLE;
