Ch. 6                                       1994 LAWS OF MARYLAND

In item (1) of this section, the former reference to how compensation is paid
to State Police employees is deleted as unnecessary in light of the specific
cross-reference to Art. 88B, § 2, which strictly limits the applicability of the
term "police employee".

Former Art. 73B, § 6-101(f)(2)(i) and (iii), which excluded members of other
State systems and contractual or temporary employees, are deleted as
unnecessary in light of the narrow and specific language of this section.

Former Art. 73B, § 6-101(f)(2)(ii), which excluded employees only partly paid
by the State, is deleted as inaccurate in light of long-standing administrative
practice.

As to former Art. 73B, § 6-101(f)(3), which gave the Board of Trustees
authority to determine membership in cases of doubt, see § 24-204 of this
subtitle.

24-202. SAME — AS A CONDITION OF EMPLOYMENT.

EXCEPT AS PROVIDED IN § 24-203 OF THIS SUBTITLE, AN INDIVIDUAL
DESCRIBED IN § 24-201 OF THIS SUBTITLE IS A MEMBER OF THE STATE POLICE
RETIREMENT SYSTEM AS A CONDITION OF EMPLOYMENT.

REVISOR'S NOTE: This section is new language derived without substantive
change from the first and second clauses of former Art. 73B, § 6-201(a).

The reference to "an individual described in § 24-201" is substituted for the
former reference to a "person who is a State Police officer" to reflect that
"State Police officer" is no longer a defined term.

Defined terms: "Member" § 20-101

"State Police Retirement System" § 20-101

24-203. SAME — OPTIONAL MEMBERSHIP FOR STATE POLICE SUPERINTENDENT.

THE SUPERINTENDENT OF THE MARYLAND STATE POLICE MAY WAIVE
MEMBERSHIP IN THE STATE POLICE RETIREMENT SYSTEM AND ELECT TO BECOME A
MEMBER OF THE EMPLOYEES' PENSION SYSTEM.

REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 73B, § 6-201(b).

"State Police Retirement System" § 20-101

24-204. SAME — DETERMINATION BY THE BOARD OF TRUSTEES.

IF ELIGIBILITY OF AN INDIVIDUAL FOR MEMBERSHIP IS UNCLEAR, THE BOARD
OF TRUSTEES SHALL DETERMINE WHETHER THE INDIVIDUAL IS A MEMBER OF THE
STATE POLICE RETIREMENT SYSTEM.
