(IV) THE BOARD OF TRUSTEES SHALL RESTORE ANY CREDITABLE
SERVICE OR ELIGIBILITY SERVICE TO THE RETIREE'S CREDIT AT THE TIME OF
RETIREMENT.

(3)      SUBJECT TO PARAGRAPH (4) OF THIS SUBSECTION, ON SUBSEQUENT
RETIREMENT OF A RETIREE DESCRIBED IN PARAGRAPH (1) OF THIS SUBSECTION,
THE BOARD OF TRUSTEES SHALL CREDIT THE RETIREE WITH ALL OF THE RETIREE'S
CREDITABLE SERVICE AND ELIGIBILITY SERVICE-AS A MEMBER.

(4)      THE ALLOWANCE, ON THE SUBSEQUENT RETIREMENT, MAY NOT
EXCEED THE SUM OF:

(I)      THE ALLOWANCE THE RETIREE WAS RECEIVING DURING THE
PREVIOUS RETIREMENT; AND

(II)     THE ALLOWANCE THAT HAS ACCRUED ON ACCOUNT OF
CREDITABLE SERVICE EARNED AFTER THE PREVIOUS RETIREMENT.

REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 73B, § 4-410.

In subsections (b) and (d)(2)(iv) and (3) of this section, the references to the
"Board of Trustees" are added for clarity.

In subsections (b) and (c) of this section, the references to "normal service
retirement allowance" are substituted for the former references to
"unreduced service allowance" and "pension" for accuracy and to reflect the
use of the term "normal service retirement allowance" in § 23-401 and
throughout this Division II to apply to an unreduced service retirement
allowance.

In subsection (c) of this section, the references to "separat[ion] from
employment" are substituted for the former references to "termination" of
service or employment to conform to Division I of this article.

In subsection (d)(2)(iv) and (3) of this section, the terms "eligibility service"
and "creditable service" are substituted for the former references to "service"
for clarity.

In subsection (d)(4)(i) of this section, the reference to the periods "during the
previous retirement" is substituted for the former reference to the period
        "before restoration" for clarity. Similarly, in subsection (d)(4)(ii) of this

section, the reference to the period "after the previous retirement" is
substituted for the former reference to the period "after restoration".
