(1)     THE RATE OF EARNABLE COMPENSATION THAT IS PAYABLE AS
MEMBER CONTRIBUTIONS;

(2)     THE COMPUTATION OF THE MEMBER'S ALLOWANCE; AND

(3)     THE COST-OF-LIVING ADJUSTMENT OF THE MEMBER'S
ALLOWANCE.

REVISOR'S NOTE: Subsections (a)(1) and (2), (b), and (c) of this section are new
language derived without substantive change from former Art. 73B, §§ 2-207
and 3-207.

Subsection (a)(3) of this section is new language added to state expressly that
which formerly only was implied — i.e., that a member may remain in the
Employees' Retirement System or the Teachers' Retirement System only if
the conditions in subsection (a)(1) and (2) are met and membership is not
otherwise terminated.

In subsection (a)(2) of this section, the phrase "at any time" is deleted as
surplusage.

Also in subsection (a)(2) of this section, the reference to not "transferring]
membership under § 22-212 of this subtitle" is substituted for the former
reference to electing to be "a member" of a pension system, for clarity.

In subsection (b)(1) of this section, the phrase "[s]ubject to subsection (c) of
this section" is added to clarify that limitations exist.

In subsection (b)(2)(iii) of this section, the word "normal", which modifies
service retirement allowance, and the phrase "multiplied by the number of
years of creditable service" are added for accuracy.

In subsection (b)(2)(v) of this section, the phrase "service or disability", which
formerly modified "allowances", is deleted as surplusage.

In subsection (b)(2)(ix) of this section, the word "eligibility" is added to
modify "service" for clarity.

In subsection (c) of this section, the phrase "§§ 22-219 through 22-221 of this
subtitle determine" is substituted for the former phrase "[a] member who is
subject to either ... is subject only to the provisions of the applicable section"
since each member is subject to one of the applicable sections.
