VETOES

(3) If the member requests a hearing within the 10-day period:

(i) The State Superintendent promptly shall hold a hearing, but a
hearing may not be set within 10 days after the State Superintendent sends the member a
notice of the hearing; and

(ii) The member shall have an opportunity to be heard publicly before
the State Superintendent in [his] THE MEMBER'S own defense, in person or by counsel.

(4) If a member who is removed so requests, the State Superintendent shall
file with the clerk of the circuit court for the county from which the member was
appointed:

(i)      A complete statement of all charges made against the member;

(ii)     The findings of the State Superintendent; and

(iii)   A complete record' of the proceedings.

3-111.1.

(A)     (1) THERE IS A PERMANENT NOMINATING CAUCUS IN HARFORD
COUNTY.

(2)      THE PURPOSE OF THE CAUCUS IS TO SELECT CANDIDATES TO FILL
VACANCIES ON THE HARFORD COUNTY BOARD OF EDUCATION AND THE HARFORD
COMMUNITY COLLEGE BOARD OF TRUSTEES.

(3)      THE PERMANENT NOMINATING CAUCUS SHALL OPERATE IN
ACCORDANCE WITH DULY ADOPTED BYLAWS.

(B)      (1) A HARFORD COUNTY BASED ORGANIZATION THAT HAS
DEMONSTRATED AN INTEREST IN PUBLIC EDUCATION MAY BECOME A MEMBER OF
THE PERMANENT NOMINATING CAUCUS IF:

(I)       IT QUALIFIES AS A NONPROFIT ORGANIZATION UNDER
SECTION 501(C) OF THE INTERNAL REVENUE CODE; AND

(II)     IT IS NONPARTISAN; AND.

(III) IT (2) ANY NONPARTISAN ORGANIZATION THAT PARTICIPATED
IN THE 1993 CAUCUS ELECTIONS AND IT DOES NOT FAIL TO VOTE IN MORE THAN
ONE ELECTION TWO ELECTIONS THEREAFTER SHALL BE A MEMBER OF THE
PERMANENT NOMINATING CAUCUS.

(2) (3) THE PERMANENT NOMINATING CAUCUS SHALL ADOPT RULES
AND PROCEDURES CONSISTENT WITH THE PROVISIONS OF THIS SECTION GOVERNING
CAUCUS MEMBERSHIP.

(C)      (1) EXCEPT AS PROVIDED IN PARAGRAPH (2) OF THIS SUBSECTION, THE
PERMANENT NOMINATING CAUCUS SHALL CONDUCT THE NOMINATING PROCESS IN
ACCORDANCE WITH ITS BYLAWS TO SELECT NO MORE THAN TWO CANDIDATES FOR
EACH VACANCY ON THE HARFORD COUNTY BOARD OF EDUCATION OR THE
HARFORD COMMUNITY COLLEGE BOARD OF TRUSTEES.
