zoning cases by ensuring that a complete and accurate record of a hearing is made. The
Office is not granted, nor should it have, the authority to act as an advocate for any party
in a zoning case, since such an action would cast doubt on the impartiality of the hearing
record.

House Bill 1092 would also result in Prince George's County's increasing its expenditures.
Currently, the County is obligated to pay for the defense of an appealed zoning decision
of the District Council. Since the Office of the People's Zoning Counsel is also
county-funded, Prince George's County would now be required to assume the costs for
both sides of a court case whenever the Zoning Counsel opts to appeal.

Lastly, I believe that this issue is best addressed at the local level through action on the
Prince George's County Charter.

For these reasons, I have vetoed House Bill 1092.

AN ACT concerning

Maryland-Washington Regional District - Prince George's County - People's Zoning

Counsel

PG/MC 19-94

FOR the purpose of reestablishing the position of the People's Zoning Counsel for Prince
George's County under the Regional District Act; providing that the People's
Zoning Counsel is entitled to compensation and certain assistance in accordance
with the County budget; specifying certain powers and duties, including the power
to appeal any final decision certain final decisions of the district council under
specified law; authorizing the district council to provide additional powers and
duties; providing for the application and intent of this Act; and generally relating to
the position of the People's Zoning Counsel in Prince George's County.
