This change resolves an inconsistency between the language of this section and the
language of Article 41, § 4-501(12) of the Code. The change essentially retains the
current law in this area. See Committee Note to Article 41, § 4-501(12) of the Code.

SECTION 3. AND BE IT FURTHER ENACTED, That the changes that are made
to Article 27, § 643B of the Code by this Act shall apply prospectively only to defendants
who are sentenced after the effective date of this Act and may not be construed to apply
in any way to defendants who are sentenced before the effective date of this Act.

SECTION 4. AND BE IT FURTHER ENACTED, That the Committee Notes
contained in this Act are not law.

SECTION 5. AND BE IT FURTHER ENACTED, That this Act shall take effect
October 1, 1994.

May 26, 1994

In accordance with Article II, Section 17 of the Maryland Constitution, I have today
