AN ACT concerning
State Personnel—Compensation—Emergency Closing of Facility State Employees - Use
of Employee Leave
FOR the purpose of specifying that when the State declares an emergency and orders a
State facility closed, a State employee at that facility is entitled to receive full pay
for the hours the facility is closed on that day; providing an exception for an
employee who has prior approval for leave on the day of the emergency limiting the
amount of leave that certain State employees must use when liberal leave policy is
initiated and the employee's facility subsequently closes; providing an exception for
an employee who has prior approval for leave on the day of the emergency; and
providing for the application of this Act.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:
Article - State Personnel and Pensions
SUBTITLE 6. MISCELLANEOUS PROVISIONS
3-601.
(A) THIS SECTION APPLIES TO ALL EMPLOYEES, INCLUDING CLASSIFIED,
UNCLASSIFIED, FULL TIME, PART TIME, AND TEMPORARY EMPLOYEES, OF ALL
UNITS IN THE EXECUTIVE, JUDICIAL, AND LEGISLATIVE BRANCHES OF STATE
GOVERNMENT, INCLUDING ANY UNIT WITH AN INDEPENDENT PERSONNEL SYSTEM
CLASSIFIED SERVICE AND UNCLASSIFIED SERVICE EMPLOYEES IN THE STATE
PERSONNEL MANAGEMENT SYSTEM.
(B) (1) EXCEPT AS PROVIDED IN PARAGRAPH (2) OF THIS SUBSECTION, ON
ANY DAY THAT THE STATE DECLARES AN EMERGENCY AND ORDERS A STATE
FACILITY CLOSED, EMPLOYEES AT THAT FACILITY SHALL RECEIVE FULL PAY FOR
THE HOURS THE FACILITY IS CLOSED.
(2) THIS SUBSECTION DOES NOT APPLY TO AN EMPLOYEE WHO HAS
RECEIVED PRIOR APPROVAL FOR LEAVE PREVIOUS TO THE DAY THAT THE
EMERGENCY IS DECLARED.
(B) (1) EXCEPT AS PROVIDED IN PARAGRAPH (2) OF THIS SUBSECTION, FOR
ANY DAY ON WHICH THE STATE OR A UNIT OF STATE GOVERNMENT INITIATES A
LIBERAL LEAVE POLICY FOR ITS EMPLOYEES AND SUBSEQUENTLY CLOSES ITS
