(4) Nothing in this section shall prevent a person from wearing, carrying, or
transporting a handgun within the confines of real estate owned or leased by him or upon
which he resid
es or within the confines of a business establishment owned or leased by
him. Nothing in this s
ection shall prevent a supervisory employee from wearing, carrying,
or transporting a handgun within the confines of a business establishment in which he is
employed during such time as he is acting in the course of his employment and has been
authorized to wear, carry, or transport the handgun by the owner or manager of the
business establishment.

(5) Nothing in this section shall prevent a person from carrying or
transporting any signal pistol or other visual distress signal approved by the United States
Coast Guard, in any vessel used upon the waterways of this State, or if unloaded and
carri
ed in an enclosed case, in any vehicle.

(6) NOTHING IN THIS SECTION SHALL PREVENT THE WEARING,
CARRYING, OR TRANSPORTING OF A HANDGUN BY A PERSON WHO:

(I) SERVED AS A LAW ENFORCEMENT OFFICER WITH A LAW
ENFORCEMENT AGENCY OF THE UNITED STATES, ANY STATE, OR A COUNTY OR
MUNICIPAL CORPORATION OF THIS STATE;

(II) WAS PERMITTED TO WEAR, CARRY, OR TRANSPORT A
HANDGUN IN CONNECTION WITH THE PERSON'S LAW ENFORCEMENT DUTIES PRIOR
TO THE PERSON'S RETIREMENT FROM A LAW ENFORCEMENT AGENCY; AND

(III) 1. RETIRED FROM A LAW ENFORCEMENT AGENCY AFTER
AT LEAST 10 YEARS OF SERVICE DUE TO A MEDICAL DISABILITY OTHER THAN A
MENTAL DISABILITY; OR

2. RETIRED AFTER AT LEAST 20 YEARS OF SERVICE FROM A
LAW ENFORCEMENT AGENCY.

36E.

(b) (1) Except as provided in paragraph (2) of this subsection, the
Superintendent may charge a nonrefundable fee not to exceed $75 for an initial
application, $50 for a renewal or subsequent application, and $10 for a duplicate or
modified permit payable at the time an application is filed. The fee may be paid with a
personal check, business check, certified check, or money order.

(2) The Superintendent may not charge any OF THE FOLLOWING PERSONS
[State, county, or municipal public safety employee, who is required to wear or carry a
handgun as a condition of government employment,] a fee for an initial application, for
a renewal or subsequent application, or for a duplicate or modified permit for that
handgun:

(I)      A STATE, COUNTY, OR MUNICIPAL PUBLIC SAFETY EMPLOYEE
WHO IS REQUIRED TO WEAR OR CARRY A HANDGUN AS A CONDITION OF
GOVERNMENT EMPLOYMENT; OR

(II)     A RETIRED LAW ENFORCEMENT OFFICER OF THE STATE OR OF
A COUNTY OR MUNICIPAL CORPORATION OF THE STATE.
