Ch. 735                                        1994 LAWS OF MARYLAND

(I) ASSIST IN THE PERFORMANCE OF CASE ASSESSMENT, CASE
PLANNING, AND CASE MONITORING;

(II) AVOID DUPLICATION OF SERVICES AND ASSURE AGENCY
ACCOUNTABILITY; AND

(III) PROVIDE LOCAL AND STATE SERVICE SYSTEM PLANNING
CAPABILITY;

(10) POLICIES AND PROCEDURES TO ESTABLISH REGULAR AND
COMPREHENSIVE INTERAGENCY EVALUATIONS OF OUT OF HOME CARE HOMES
AND FACILITIES FOR CHILDREN AND OTHER PROVIDERS OF CHILDREN AND
FAMILY SERVICES; AND

(11) POLICIES AND PROCEDURES TO ENCOURAGE RECOMMENDATIONS
FROM ALL INTERESTED ORGANIZATIONS AND INDIVIDUALS TO THE SUBCABINET
ON THE IMPLEMENTATION AND MODIFICATION OF THE SYSTEM ESTABLISHED
UNDER SUBSECTION (A) OF THIS SECTION.

(C) ANY FUNDS AVAILABLE FOR OUT OF HOME CARE AND SERVICES AND
FOR FAMILY PRESERVATION SERVICES UNDER THIS ARTICLE MAY BE USED TO
FUND THE SYSTEM OF ASSESSMENT, CASE PLANNING, AND CASE MONITORING
ESTABLISHED UNDER THIS SECTION, IN ACCORDANCE WITH THE PLANS DEVELOPED
UNDER §§ 19.1 AND 38 OF THIS ARTICLE.

(D) IN IMPLEMENTING THE STATEWIDE SYSTEM UNDER SUBSECTION (A), THE
SUBCABINET MAY MODIFY THE STATE/LOCAL COORDINATING COUNCIL SYSTEM
FOR RESIDENTIAL PLACEMENT OF CHILDREN WITH DISABILITIES ESTABLISHED
UNDER THIS ARTICLE.

5.

(a) The children's councils are a part of the [Office] SUBCABINET for Children,
Youth, and Families and exercise the powers and duties specified in this article.

(g) It is the responsibility of each children's council to:

(4) Identify, document, and communicate needs, resources, and priorities in
their jurisdictions to the local governing body, THE LOCAL PLANNING ENTITY, and [to]
the [Office for Childr
en, Youth, and Families] SUBCABINET;

(c) The [Office for Children, Youth, and Families] SUBCABINET may expend a
gift to th
e State to or for the use of the Children's Trust Fund only in the manner and for
the purpos
es stated in this section.

(d) The [Special Secretary of the Office for Children, Youth, and Families]
SUBCABINET shall expend the funds collected under § 4-217(a)(2) of the

Health - General Article for the use of the Children's Trust Fund as appropriated in the

annual State budget and only in the manner and for the purposes stated in this section.
