Preamble
WHEREAS, Under Chapter 780 of the Acts of 1988 the General Assembly
repealed provisions of law that required certain transfers of employer contributions be
made from one retirement or pension system in the State to another; and
WHEREAS, Chapter 780 was to be applied retroactively to Fiscal Year 1982; and
WHEREAS, Chapter 780 failed to repeal a similar requirement that applied
specifically to transfers of employees from the Maryland National Capital Park and
Planning Commission, the Washington Suburban Sanitary Commission, or the
Washington Suburban Transit Commission to the counties that these commissions
service; and
WHEREAS, There is no provision of law that requires the counties serviced by
these commissions to transfer employer contributions when an employee of the county
transfers to one of these commissions; and
WHEREAS, It is the intent of the General Assembly to repeal the provision of law
that places the commissions in an inequitable position compared to the State and political
subdivisions of the State; now, therefore,
SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:
Article 73B - Pensions

(a) Any employee who was a member of a retirement system by reason of
employment or prior employment with the Maryland-National Capital Park and Planning
Commission, the Washington Suburban Sanitary Commission, or the Washington
Suburban Transit Commission and who transfers to another retirement system of a
county within the area encompassed by the responsibilities of these agencies AS THE
RESULT OF THE TRANSFER OF A UNIT OF THE MARYLAND-NATIONAL CAPITAL PARK AND
PLANNING COMMISSION POLICE FORCE TO THE PRINCE GEORGE'S COUNTY POLICE
DEPARTMENT, shall have both the employee's contributions, if not previously withdrawn,
