SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:
Article 17 - Clerks of Courts
74.
(a) For receiving, collecting and paying over all public money — 5% except the
clerk of the Circuit Court for Montgomery County, who shall receive 3% commission,
provided that the clerk of the Circuit Court for Baltimore County and Anne Arundel
County shall be entitled to receive 3% and the clerk of the Circuit Court for Baltimore
City shall be entitled to receive 2 1/2% of the amount collected from the tax applicable to
instruments recorded with the said respective clerks under Title 12 of the Tax - Property
Article, but shall be entitled to receive 5% for receiving, collecting and paying over all
other public moneys. The clerk of the court for Harford County shall be entitled to
receive 3% of the amount collected from the tax applicable to instruments recorded with
the said clerk under Title 12 of the Tax - Property Article but shall be entitled to receive
5% for receiving, collecting and paying over all other public moneys.
(b) Notwithstanding subsection (a) of this section, in St. Mary's County, the Clerk
of the Circuit Court is not entitled to a collection fee for collecting the county transfer tax
under Chapter 138 of the Public Local Laws of St. Mary's County when the Clerk collects
both the recordation tax under Title 12 of the Tax - Property Article and the county
transfer tax for the filing of a single instrument of writing.
(C) NOTWITHSTANDING SUBSECTION (A) OF THIS SECTION, IN CHARLES
COUNTY, THE CLERK OF THE CIRCUIT COURT SHALL DEDUCT FROM COLLECTION
FEES FOR THE TAX COLLECTED UNDER TITLE 12 OF THE TAX - PROPERTY ARTICLE
AND PAY TO THE CHARLES COUNTY TREASURER THE COST OF TWO-THIRDS OF THE
SALARIES AND BENEFITS OF THE COURT REPORTERS FOR THE CIRCUIT COURT OF
CHARLES COUNTY. THE CLERK OF THE CIRCUIT COURT SHALL MAKE THE PAYMENT
PROMPTLY AFTER RECEIPT OF A VOUCHER FROM THE CHARLES COUNTY
TREASURER STATING THE AMOUNT OF THE SALARIES AND BENEFITS PAID FOR THE
COURT REPORTERS.

(c) (1) The resident judge in each county of the seventh judicial circuit shall
appoint one or more official court reporters for the circuit court in the county. A reporter
shall be competent to record court proceedings and shall serve at the pleasure of the
judge who appointed him. The reporter shall receive the compensation set by the county
government after consultation with the county administrative judge.
(2) [In Charles County the County Commissioners are responsible for one
third of the salary of the court reporter. The clerk of the court shall pay the salary to the
reporter or reporters biweekly from the fees of his office. Prior to May 1 each year the
clerk shall submit a voucher to the County Commissioners. They shall promptly reimburse
him for one third of the amount of the reporter's salary.
