Ch. 572

(B)      [Every] EXCEPT AS PROVIDED IN SUBSECTION (C) OF THIS SECTION,
EVERY person, his aiders, abettors and counsellors, who shall be convicted of the crime
of breaking a storehouse, filling station, garage, trailer, cabin, diner, warehouse or other
outhouse or into a boat in the day or night with an intent to commit murder or felony
therein, or with the intent to steal, take or carry away the personal goods of another of the
value of $300 or more therefrom, shall be guilty of a felony, and upon conviction
sentenced to the penitentiary for not more than [ten] 10 years.

(C)     A PERSON WHO VIOLATES SUBSECTION (B) OF THIS SECTION WITH THE
INTENT TO STEAL, TAKE, OR CARRY AWAY A FIREARM IS GUILTY OF A FELONY AND
ON CONVICTION SHALL BE SUBJECT TO IMPRISONMENT FOR NOT MORE THAN 20
YEARS OR A FINE OF NOT MORE THAN $10,000 OR BOTH.

SECTION 2. AND BE IT FURTHER ENACTED, That the Laws of Maryland
read as follows:

Article 27 - Crimes and Punishments

28.

(F) "FIREARM" INCLUDES:

(1)      HANDGUN, ANTIQUE, FIREARM, RIFLE, SHOTGUN,
SHORT-BARRELED SHOTGUN, AND SHORT-BARRELED RIFLE, AS THOSE TERMS ARE
DEFINED IN § 36F OF THIS ARTICLE;

(2)      PISTOL, REVOLVER, AND ANTIQUE PISTOL OR REVOLVER, AS THOSE
TERMS ARE DEFINED IN § 441 OF THIS ARTICLE:

(3) ASSAULT WEAPON, AS DEFINED IN § 481E OF THIS ARTICLE:

(4)      MACHINE GUN, AS DEFINED IN § 372 OF THIS ARTICLE; AND

(5)      ANY OTHER FIREARM THAT HAS NOT BEEN MODIFIED TO RENDER
IT PERMANENTLY INOPERATIVE.

30.

(a) A person may not break and enter the storehouse of another with the intent to
commit theft, a crime of violence, or arson in the second degree.

(B) A PERSON MAY NOT BREAK AND ENTER THE STOREHOUSE OF ANOTHER
WITH INTENT TO STEAL, TAKE, OR CARRY AWAY A FIREARM.

[(b)](C) A person who violates this section is guilty of the felony of burglary in
the second degree and on conviction is subject to:

(1) [imprisonment] FOR A VIOLATION OF SUBSECTION (A) OF THIS
SECTION, IMPRISONMENT for not more than 15 years; AND

(2) FOR A VIOLATION OF SUBSECTION (B) OF THIS SECTION,
IMPRISONMENT FOR NOT MORE THAN 20 YEARS OR A FINE OF NOT MORE THAN
$10,000 OR BOTH.
