(11) ANY AREA COVERED BY A PAVED PARKING LOT THAT IS IN
EXISTENCE AT THE TIME OF APPLICATION FOR SUBDIVISION OR FOR A GRADING OR
SEDIMENT CONTROL PERMIT.

5-1603.

(c) (3) (i) A local authority shall review and amend, as appropriate, all
current local ordinances, policies and procedures that are inconsistent with the intent and
requirements of this subtitle such as parking, road width, setback, curb and gutter,
grading, and sidewalk requirements.

(ii) A local forest conservation program, when approved by the
Department, may [allow]:

1. ALLOW clustering and other innovative land use techniques
that protect and establish forests where open space is preserved, sensitive areas are
protected, and development is physically concentrated; AND

2. WAIVE THE REQUIREMENTS OF THIS SUBTITLE FOR AN
AREA THAT WAS PREVIOUSLY DEVELOPED AND IS COVERED BY PAVED SURFACE
AT THE TIME OF APPLICATION FOR SUBDIVISION PLAN, GRADING, OR SEDIMENT
CONTROL PERMIT APPROVAL.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect
October 1, 1994.

AN ACT concerning

Phragmites - Annual Reports - Management and Control

FOR the purpose of requiring the Department of Transportation and the Department of
Natural Resources to study and analyze the progress made in the management and
control of the spread of phragmites on certain lands; requiring the Department of
Natural Resources with certain other agencies to inventory phragmites on certain
lands in the State; requiring the Department of Transportation and the Department
of Natural Resources to submit certain annual reports to the Environmental
Matters Committee and the Economic and Environmental Affairs Committee;
making a stylistic change; repealing certain obsolete language; and generally
relating to reporting on phragmites.
