AN ACT concerning

Injured Workers' Insurance Fund - Exemption From Laws Affecting Governmental Units
- Fiscal Year - Appointment and Employment of Attorneys

FOR the purpose of clarifying the provisions exempting, with certain express exceptions,
the Injured Workers' Insurance Fund from any law affecting governmental units;
providing that the calendar year is the fiscal year of the Fund beginning with
calendar year 1994; and authorizing the Fund to appoint or employ attorneys.

BY repealing and reenacting, with amendments,

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article - Labor and Employment

10-105.

(a)     The Fund is independent of all State units.

(b)     (1) Except as provided in paragraph (2) of this subsection and elsewhere in
this subtitle, the Fund is not subject to any law, INCLUDING § 6-106 OF THE STATE
GOVERNMENT ARTICLE, that affects governmental units.

(2)     The Fund is subject to:

(i)     Title 10, Subtitle 5 of the State Government Article;

(ii)    Title 10, Subtitle 6, Part III of the State Government Article;

(iii)   Title 12 of the State Government Article;

(iv)    the Maryland Public Ethics Law; and

(v)     Title 3, Subtitle 3 of the State Personnel Article.

(3)     Paragraph (1) of this subsection does not affect the exemption from
property tax under § 7-210 of the Tax - Property Article.

10-106.

BEGINNING WITH CALENDAR YEAR 1994, [The fiscal] THE CALENDAR year [of
the State] is the fiscal year of the Fund.
