(Senate Bill 596)

AN ACT concerning

Old Dorchester County Jail - Preservation - Referendum

FOR the purpose of authorizing the Board of County Commissioners of Dorchester
County to place on the ballot a binding referendum concerning the future of the old
Dorchester County jail, located on Court Lane in Cambridge, Maryland, in the
general election to be held November 1994; requiring the Board of Supervisors of
Elections of Dorchester County to take certain actions should the County
Commissioners choose to place the issue on the ballot; requiring the County
Commissioners to give certain notice to the Board of Supervisors of Elections of
Dorchester County by a specified date; providing that the election results shall be
binding on the Board of County Commissioners serving on the election date and on
the subsequent Board elected November 1994; and generally relating to a
referendum in Dorchester County concerning the future of the old Dorchester
County jail.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Board of County Commissioners of Dorchester County, by
resolution, may place on the ballot at the general election in Dorchester County, to be
held in November 1994, the question of whether the old Dorchester County jail, located
on Court Lane in Cambridge, Maryland, shall be preserved or demolished. If the Board of
County Commissioners choose to place the question on the ballot, the County
Commissioners shall notify the Board of Supervisors of Elections of Dorchester County
on or before September 1, 1994. If the Board of County Commissioners places the
question on the ballot, the decision of the majority of the voters of Dorchester County
voting on the question shall be binding on the Board of County Commissioners serving on
the date of the election, and on the subsequent Board of County Commissioners, elected
to office at the general election held November 1994.

SECTION 2. AND BE IT FURTHER ENACTED, That, should the Board of
County Commissioners of Dorchester County choose to place the question concerning the
future of the old Dorchester County jail on the ballot in Dorchester County in the general
election to be held November 1994, the Board of Supervisors of Elections of Dorchester
County shall do those things necessary and proper to provide for and hold the
referendum required. There shall be printed on the ballot to be used at the election the
title "Future of the old Dorchester County jail located on Court Lane in Cambridge" and
under the title, on separate lines, the words "For the preservation of the old Dorchester
County jail" and the words "Against the preservation of the old Dorchester County jail",
whereby a voter may select one but not both of the two options.

SECTION 3. AND BE IT FURTHER ENACTED, That this Act shall take effect
June 1, 1994.
