Ch. 485                                    1994 LAWS OF MARYLAND

WHEREAS, The State's current fiscal climate requires that Maryland's public
higher education institutions maintain personnel and procurement management flexibility
in order to maximize efficiency and cost savings; and

WHEREAS, It is the intent of the Administration and the General Assembly to
ensure that Maryland's public colleges and universities are managed in a manner
consistent with good business practices, in the best interest of the citizens of Maryland;
and

WHEREAS, With the exception of Morgan State University, the governing boards
of all other 4-year Maryland public colleges and universities have been granted the
authority for managing procurement and personnel matters and have been able to
operate in a more efficient and effective manner; and

WHEREAS, It is the intent of the General Assembly to grant to the governing
board of Morgan State University broader management authority and flexibility; and

WHEREAS, Granting the governing board of Morgan State University the
authority for managing procurement and personnel matters will assist the University in
meeting its educational mission, allow for more efficient and effective management of the
University's operation, and assist the University in meeting the goals established in the
1988 reorganization legislation; now, therefore,

SECTION 1. BE IT ENACTED BY THE GENERAL' ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article - Education

14-101.                                                                                                            

There is a Morgan State University, which:                                         

(1)     Has the responsibility, with other educational institutions, for providing
higher education research and graduate study in the Baltimore area;

(2)     Is the State's public urban university with a mission of instruction,
research, and service;

(3) Offers baccalaureate and graduate degrees in the arts and sciences;

(4)     Emphasizes an education addressing urban concerns; and         

(5)     Offers the professional and graduate programs approved by its Board of
Regents and the Maryland Higher Education Commission.

14-102.

(a)     The government of Morgan State University is vested in the Board of Regents
of Morgan State University;

(b)     The Board of Regents consists of 13 members appointed by. the Governor with
the advice and consent of the Senate.                                                   

(c)     (1) Each member of the Board shall be a resident of this State.
