provided in the Maryland Rules. The funds collected under this section shall be remitted
to the Comptroller and credited to the [General Fund] VICTIM AND WITNESS
PROTECTION AND RELOCATION FUND ESTABLISHED UNDER ARTICLE 27, § 770 OF
THE CODE
.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect
July 1, 1994.

CHAPTER 475
(Senate Bill 274)

AN ACT concerning

Orders of Restitution - Collection and Enforcement

FOR the purpose of altering certain definitions so as to permit the central collection unit
of the Department of Budget and Fiscal Planning to collect certain restitution
payments under certain circumstances; providing that the Criminal Injuries
Compensation Board is subrogated to the right to recover certain restitution
payments after paying certain claims; requiring certain inmates who obtain
employment while incarcerated in certain local jails to pay certain restitution
payments; requiring a court to order restitution under certain circumstances;
establishing a certain rebuttable presumption; requiring that compliance with an
order of r
estitution be made as a. sentence and, if probation is ordered, as a
condition of probation; requiring that certain information be provided to th
e
Division of Parole and Probation to facilitate the collection of restitution
establishing that a victim is presumed to have a right to restitution under certain
circumstances; providing that a court need not issue an order of restitution under certain
circumstances; requiring that compliance with an order of restitution be made as a
condition of probation, if probation is ordered; requiring the Department of Public Safety
and Correctional Services to obtain certain information to facilitate the collection of
restitution;
requiring a State's Attorney to notify eligible victims of the right to
request restitution and to provide certain assistance and advice to such victims
under certain circumstances; permitting the Division of Parole and Probation to
refer a delinquent restitution account to the central collection unit under certain
circumstances; authorizing the central collection unit to collect delinquent
restitution accounts in a certain manner; establishing certain notice procedures on the
satisfaction of an order of restitution; establishing the time period in which a payment
under an order of restitution is considered delinquent;
permitting the central collection
unit, under certain circumstances, to certify to the Comptroller and to the State
Lottery Agency that a defendant is in arrears of restitution payments; requiring the
State Lottery Agency to take certain action after receiving a certification from the
central collection unit; permitting a court to issue an earnings withholding order in
a certain amount after issuing an order of restitution; providing for the priority of
execution of certain earnings withholding orders; establishing certain procedures for
