SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect
October 1, 1994.

Weights and Measures - Civil Penalties

FOR the purpose of authorizing the Secretary of Agriculture to impose a certain civil
penalty penalties on any person who violates the weights and measures law; and
generally relating to the rules concerning the weights and measures law.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:           

Article - Agriculture

11-415. 11-208.1.

(A)     INSTEAD OF OR IN ADDITION TO ANY PENALTY PURSUING CRIMINAL
CHARGES PROVIDED IN THIS ARTICLE, THE SECRETARY MAY IMPOSE ON ANY
PERSON WHO VIOLATES THIS TITLE A CIVIL PENALTY OF NOT MORE THAN $5,000 ON
ANY PERSON WHO VIOLATES. THIS TITLE:

(1)     FOR A FIRST VIOLATION, NOT MORE THAN $1,000 $500;

(2)     FOR A SECOND VIOLATION, NOT MORE THAN $1,750 $1,000; OR

(3)     FOR A THIRD OR SUBSEQUENT VIOLATION, NOT MORE THAN $2,500
$2,000.

(B)     PENALTIES COLLECTED BY THE SECRETARY UNDER THIS SECTION SHALL
BE PAID INTO THE GENERAL FUND OF THE STATE.
