(iii) except as provided in paragraph (2) of this subsection, may include
any other benefit option that the Secretary considers appropriate.

(2) The Program may not contain any of the benefits provided under
[Article 73B or Article 73C of the Code] DIVISION II OR TITLE 35 OR TITLE 37 OF THIS
ARTICLE.

8-107.

(b)     The surviving spouse of a State employee who died while employed by this
State may enroll and participate in the health insurance benefit options established under
the Program as long as the surviving spouse is receiving an allowance under [Article 73B,
§ 2-417, § 3-414, § 4-414, § 5-413, § 6-411, § 7-410, § 8-408, or § 9-104 of the Code]
TITLE 29, SUBTITLE 2 OF THIS ARTICLE.

(c)     The surviving minor child or dependent parent of a State Police officer who
died while employed by this State may enroll and participate in the health insurance
benefit options established under the Program as long as the child or parent is receiving
an allowance under [Article 73B, § 6-411 of the Code] TITLE 29, SUBTITLE 2 OF THIS
ARTICLE.

8-108.

(a) (1) In this section the following words have the meanings indicated.

(2)     "Creditable service" means:

(i) service credited toward a retirement allowance under [Article 73B
of the Code] DIVISION II OF THIS ARTICLE; or

(ii) service [as a judge, as defined in Article 73B, § 9-101 of the
Code] WHILE A MEMBER OF THE JUDGES' RETIREMENT SYSTEM UNDER TITLE 27 OF
THIS ARTICLE.

(3)     (i) "Retiree" means:

1.       a former State employee who receives a retirement allowance
under [Article 73B of the Code] DIVISION II OF THIS ARTICLE; or

2.       a former employee of the Medical System Corporation, as
defined in § 13-1B-01 or § 13-1C-01 of the Education Article, who receives a retirement
allowance from the Employees' Retirement System of the State of Maryland or the
[Pension System for Employees] EMPLOYEES' PENSION SYSTEM of the State of
Maryland under [Title 10, Subtitle 1 of Article 73B of the Code] TITLE 22 OR TITLE 23
OF THIS ARTICLE.

(ii) "Retiree" does not include:

1.       a member of the faculty or staff of a community college;

2.       a teacher or a staff member employed by a county board of
education; or
