Ch. 468                                        1994 LAWS OF MARYLAND                     

(i) Employer contribution; and

            (ii) Employee contribution withheld from the employees'

compensation by the State in accordance with City ordinance.

                  (3) For those employees electing to become members of the [Pension

System for the Employees] EMPLOYEES' PENSION SYSTEM of the State of Maryland, the
transfer of employer and employee contributions shall be as provided in [Article 73B, §
1-403 of the Code] § 37-205 OF THE STATE PERSONNEL AND PENSIONS ARTICLE.

Article - Education

5-202.1.                                                                       

(a)      In this section, "Agency" means the [Maryland] State Retirement Agency.

(b)     The [Maryland State Retirement] Agency may at any time examine the
records of local school systems to determine whether the State's payments for retirement
contributions for employees of the school systems are in accordance with the provisions of
[Article 73B of the Code] DIVISION II OF THE STATE PERSONNEL AND PENSIONS
ARTICLE.

(c)      (1) (i) If an examination of the records of a local school system shows that
the State has paid more than is required under [Article 73B of the Code] DIVISION II OF
THE STATE PERSONNEL AND PENSIONS ARTICLE, within 30 days after the date of the
notice to the school system of the State overpayment, the school system may appeal the
notice of State overpayment to the Secretary of Budget and Fiscal Planning who shall
appoint a hearing examiner.

11-104.                                                                                             

(d), (1) Each employee of the Commission shall join the [State] Teachers'
Pension System OF THE STATE OF MARYLAND or the [State] Employees' Pension
System OF THE STATE OF MARYLAND.                                                                      

(2) Any employee of the Commission who is determined by the Secretary to
hold a professional position may join the optional retirement program under [Article
73B, Title 11 of the Code] TITLE 30 OF THE STATE PERSONNEL AND PENSIONS
ARTICLE.                                                                                                                         

12-108. .                                                                

(d)      (1) Each employee of the Board shall join the [State] Teachers' Pension
System OF THE STATE OF MARYLAND or the [State] Employees' Pension System OF
THE STATE OF MARYLAND.

(2) As an alternative, any employee in a position determined by the Board
to be a professional position may join the optional retirement program under [Article
73B, Title 11 of the Code] TITLE 30 OF THE STATE PERSONNEL AND PENSIONS
ARTICLE.
