SECTION 2. AND BE IT FURTHER ENACTED, That if any provision of this
Act or the application thereof to any person or circumstance is held invalid for any reason
in a court of competent jurisdiction, the invalidity does not affect other provisions or any
other application of this Act which can be given effect without the invalid provision or
application, and for this purpose the provisions of this Act are declared severable.
SECTION 2. 3. AND BE IT FURTHER ENACTED, That this Act shall take
effect October 1, 1994.

AN ACT concerning
Vehicle Theft Prevention Council and Vehicle Theft Prevention Fund
FOR the purpose of establishing the Vehicle Theft Prevention Council within the
Department of Public Safety and Correctional Services to assist in the prevention
and deterrence of vehicle theft and related crimes in Maryland; providing for the
membership of the Council; providing for the powers and duties of the Council;
establishing a Vehicle Theft Prevention Fund to be used by the Council;
establishing the uses of the Fund; establishing an assessment on certain insurers to
fund the Fund; providing that the Fund is not part of the General Fund; authorizing
an assessment to be billed to certain policyholders under certain circumstances
providing for the transfer of certain revenues into the Fund; defining certain terms;
permitting expenditures from the Fund under certain circumstances; requiring a
certain department to evaluate a certain program and issue a report by a certain
date; specifying the terms of the initial members of the Council; providing for the
termination of this Act; making stylistic changes; and generally relating to the
establishment of the Vehicle Theft Prevention Council and the Vehicle Theft
Prevention Fund.
BY repealing and reenacting, with amendments,
