(House Bill 520)

AN ACT concerning

Child Abuse and Neglect - Removal of Names from Central Registry

FOR the purpose of requiring the Department of Human Resources to remove without
the necessity of a request the names of certain individuals in a certain central
registry of child abuse and neglect within a certain time period under certain
circumstances; repealing a certain contingency relating to certain proposed decisions
and orders issued by an administrative law judge directing the Department to amend,
modify, or expunge certain findings of child abuse and neglect;
and generally relating to
child abuse and neglect.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article - Family Law

5-715.

(a)     The Secretary of Human Resources shall adopt regulations necessary to
protect the rights of persons suspected of abuse or neglect.

(b)     Before the name of a person who is suspected of abuse or neglect is entered in
a central registry, the person shall be given notice.

(c)      (1) Except as provided in paragraph (3) of this subsection, on request by a
person suspected of abuse or neglect, the Department shall hold an administrative
hearing for the purpose of allowing the person to appeal the entry of the person's name
in a central registry.

(2) The hearing shall be held in the county in which the person suspected of
abuse or neglect resides.
