Ch. 199                                    1994 LAWS OF MARYLAND

The Board of Public Works shall make available in installments funds authorized
under this Act. The Board of Public Works shall c
ertify the amount of each installment to
the proper State officers, and the Treasurer shall mak
e payment to or on behalf of the
applicant, when needed, for the repair, renovation, rehabilitation, and expansion of the
Franciscan Cent
er.

Tho Board of Public Works may adopt regulations for disbursing the installments.

(6)     No portion of the proceeds of the loan or any of the matching funds may be
used for the furtherance of sectarian religious instruction, or in connection with the
design, acquisition, or construction of any building used or to be used as a place of
sectarian religious worship or instruction, or in connection with any program or
department of divinity for any religious denomination. Upon the request of the Board of
Public Works, the Board of Directors of the Franciscan Center, Inc. shall submit evidence
satisfactory to the Board that none of the proceeds of the loan or any matching funds has
been or is being used for a purpose prohibited by this Act.

(7)     (a) Prior to the issuance of the bonds, the Board of Directors of the
Franciscan Center, Inc. shall grant and convey to the Maryland Historical Trust a
perpetual preservation easement to the extent of its interest:

(i) On the land or such portion of the land acceptable to the Trust;
and

(ii) On the exterior and interior, where appropriate, of the historic
structures.

(b) The easement must be in form and substance acceptable to the Trust
and the extent of the interest to be encumbered must be acceptable to the Trust.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect
June 1, 1994.

AN ACT concerning

Higher Education - University of Maryland College Park System and St. Mary's College
of Maryland - Governing and Institutional Boards

FOR the purpose of requiring the institutional board boards established for the
University of Maryland College Park System, known as the Board of Trustees
Boards of Visitors, to submit a report by a certain date each year to certain
individuals; specifying the requirements for the contents of the report; altering the
membership of the Board of Trustees of St. Mary's College of Maryland; providing
that certain appointments shall be made upon the recommendation of the Board of
