(5) Prior to the payment of any funds under the provisions of this Act for the
purposes set forth in Section 1(3) above, the Board of Directors of Montgomery Hospice
Society, Inc. shall provide and expend a matching fund. No part of an applicant's
matching fund may be provided, either directly or indirectly, from funds of the State,
whether appropriated or unappropriated. No part of the fund may consist of real
property, or in kind contributions. The fund may consist of in kind contributions, or in kind
contributions or funds expended prior to the effective date of this Act. In case of any
dispute as to the amount of the matching fund or what money or assets may qualify as
matching funds, the Board of Public Works shall determine the matter and the Board's
decision is final. The Board of Directors of Montgomery Hospice Society, Inc. has until
June 1, 1996, to. present evidence satisfactory to the Board of Public Works that a
matching fund will be provided. If satisfactory evidence is presented, the Board shall
certify this fact and the amount of the matching fund to the State Treasurer, and the
proceeds of the loan equal to the amount of the matching fund shall be expended for the
purposes provided in this Act. Any amount of the loan in excess of the amount of the
matching fund certified by the Board of Public Works shall be canceled and be of no
further effect.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect
June 1, 1994.

AN ACT concerning

State Board of Dietetic Practice - Continuation

FOR the purpose of continuing the State Board of Dietetic Practice (Board) and certain
provisions of law relating to the statutory authority of the Board to regulate the
practice of dietetics in the State in accordance with the Maryland Program
Evaluation Act; altering the composition of the Board; requiring certain
organizations to notify certain individuals of certain vacancies on the Board to
solicit nominations to fill the vacancies and to conduct a certain balloting process
altering certain procedures for the submission of nominees to the Secretary of
Health and Mental Hygiene to fill certain vacancies on the Board requiring certain
persons to notify certain individuals of certain vacancies on the Board for the purpose of
soliciting nominations to fill the vacancies and to conduct a certain balloting process;
specifying the number of qualified nominees that shall be on the list submitted to the
Secretary to fill vacancies on the Board; altering certain requirements to qualify for
licensure as a dietitian or a licensed nutritionist; repealing a provision of law that
authorizes the Board to waive certain examination requirements only under certain
circumstances; adding certain grounds for discipline; extending the date for the
evaluation of the State Board of Dietetic Practice; and generally relating to the
