WILLIAM DONALD SCHAEFER, Governor                           Ch. 114

(1) PASSING THE TEST FOR LEAD CONTAMINATED DUST UNDER § 6 816
OF THIS SUBTITLE; OR

(2) PERFORMING THE LEAD HAZARD REDUCTION TREATMENTS
SPECIFIED IN § 6-817(A) OF THIS SUBTITLE.

(B) (1) TO MAINTAIN COMPLIANCE WITH THE RISK REDUCTION STANDARD
ESTABLISHED UNDER THIS SUBTITLE, AT LEAST EVERY 2 YEARS AFTER THE INITIAL
TEST OR TREATMENT PERFORMED UNDER SUBSECTION(A) OF THIS SECTION THE
OWNER OF AN AFFECTED PROPERTY SHALL:

(I) PASS A TEST FOR LEAD CONTAMINATED DUST UNDER § 6-816
OF THIS SUBTITLE; OR

(II) PASS A VISUAL INSPECTION, BY PERFORMING ANY NECESSARY
LEAD HAZARD REDUCTION TREATMENTS AS SPECIFIED IN § 6-817(B) OF THIS
SUBTITLE.

(2) THE COMMISSION MAY ALTER THE REQUIREMENTS OF PARAGRAPH
(1) OF THIS SUBSECTION IN ORDER TO FACILITATE THE NEEDS OF DIFFERENT
OWNERS.

(C) IF AN OWNER OF AN AFFECTED PROPERTY MAKES ALL THE WINDOWS IN
THE PROPERTY LEAD SAFE BY WINDOW REPLACEMENT OR ANY OTHER MEANS

APPROVED BY THE DEPARTMENT, AS VERIFIED BY PASSING A

LEAD CONTAMINATED DUST TEST OF THE PROPERTY, THE PERIOD SPECIFIED IN
SUBSECTION (B) OF THIS SECTION SHALL BE EXTENDED TO EVERY 5 YEARS,
COMMENCING WITH THE DATE OF THE PASSING TEST.

6-816.

THE COMMISSION SHALL ESTABLISH PROCEDURES AND STANDARDS FOR
LEAD CONTAMINATED DUST TESTING BY REGULATION.

6-817.

(A)     THE COMMISSION SHALL SPECIFY BY REGULATION THE LEAD HAZARD
REDUCTION TREATMENTS THAT ARE NECESSARY TO SATISFY THE RISK REDUCTION
STANDARD AT A CHANGE IN OCCUPANCY.

(B)     A VISUAL INSPECTION OF THE AFFECTED PROPERTY, AND ANY
NECESSARY HAZARD REDUCTION TREATMENTS, SPECIFIED UNDER § 6 815(B)(1)(II)
OF THIS SUBTITLE WHILE THE PROPERTY IS OCCUPIED, SHALL BE LIMITED TO
REVIEW AND CORRECTION OF THE FOLLOWING:

(1) AREAS OF CHIPPING, PEELING, AND FLAKING PAINT;

(2) STRUCTURAL DEFECTS OF WHICH THE OWNER KNOWS, OR IN THE
EXERCISE OF REASONABLE CARE, SHOULD KNOW; AND

(3) DEVIATIONS FROM THE TREATMENTS SPECIFIED IN SUBSECTION (A)
OF THIS SECTION, PROVIDED THAT THE OWNER MAY NOT BE REQUIRED TO:
