(f) The Department OF BUDGET AND FISCAL PLANNING shall provide
administrative support to the Advisory Council.
SECTION 2. AND BE IT FURTHER ENACTED, That:
(a) There is hereby transferred to the Department of Budget and Fiscal Planning
all rights, powers, duties, obligations, and functions that were exercised by and granted to
the Department of Personnel under Title 8, Subtitle 1 (Health and Welfare Benefits
Program) of the State Personnel and Pensions Article;
(b) All boards, commissions, programs, and other units within the Department of
Personnel necessary to carry out the provisions of this Act that were created by statute,
regulation, executive order, secretarial or unit directive, or other executive action shall be
transferred to the Department of Budget and Fiscal Planning on the effective date of this
Act;
(c) All persons who are employees of the Department of Personnel and whose
positions are transferred to the Department of Budget and Fiscal Planning pursuant to
this Act are hereby transferred to the Department of Budget and Fiscal Planning, without
any diminution of their rights, benefits, or status, including, if any, merit system and
retirement status, provided that neither the Department of Personnel nor the
Department of Budget and Fiscal Planning may increase the number of positions
allocated to carrying out the functions of the State Employee and Retiree Health and
Welfare Benefits Program by budget amendment for the 1994 fiscal year or the 1995 fiscal
year;
(d) All property, including all real and personal property, records, fixtures,
appropriations, credits, assets, liabilities, obligations, rights, and privileges, held by the
Department of Personnel to carry out the functions of the State Employee and Retiree
Health and Welfare Benefits Program, shall be transferred to the Department of Budget
and Fiscal Planning on the effective date of this Act;
(e) All existing laws, regulations, proposed regulations, standards and guidelines,
proposed standards and guidelines, appropriations, funds, grants or applications for
grants, policies, orders, and other directives, forms, plans, memberships, contracts,
property, investigations, administrative and judicial responsibilities, rights to sue and be
sued, and all other duties and responsibilities associated with those functions transferred
by this Act shall continue in effect under the Secretary of Budget and Fiscal Planning or
a unit within the Department until completed, withdrawn, canceled, modified, or
otherwise changed pursuant to law; and
(f) Any transaction affected by or flowing from any statute here amended,
repealed, or transferred, and validly entered into before the effective date of this Act and
every right, duty or interest flowing from it remains valid after the effective date of this
Act and may be terminated, completed, consummated, or enforced pursuant to law.
