Ch. 98                                          1994 LAWS OF MARYLAND

ARTICLE AND THE REGULATIONS OF THE BOARD OF LICENSE COMMISSIONERS FOR
A CLASS B BEER, WINE AND LIQUOR (ON-SALE) HOTEL AND RESTAURANT LICENSE,
WITH THE FOLLOWING ADDITIONAL REQUIREMENTS:

(1)      THE LICENSE MAY BE ISSUED ONLY FOR A FACILITY OPERATED AS
A DINNER THEATRE WHICH:

(I)       PROVIDES LIVE BROADWAY-STYLE AND OTHER MUSICALS,
COMEDY, OR DRAMA TO ITS CUSTOMERS;

(II)     IS OPEN TO THE PUBLIC BY TICKET PURCHASE OR
RESERVATION ONLY; AND

(III)    CONTAINS A DINING ROOM AND FACILITIES FOR PREPARING
AND SERVING FULL-COURSE MEALS FOR AT LEAST 175 PERSONS AT ONE SEATING;

(2)      THE HOLDER OF A CLASS B (DT) LICENSE MAY SELL:

(I)       BEER AND WINE BY THE DRINK OR BY THE BOTTLE;

(II)     LIQUOR BY THE DRINK ONLY;

(III)    AT RETAIL FOR ON-PREMISES CONSUMPTION BEGINNING 2
HOURS BEFORE THE LIVE PERFORMANCE THROUGH THE END OF THE
PERFORMANCE; AND

(IV)    SEVEN DAYS PER WEEK; AND

(3) THE HOLDER OF A CLASS B (DT) LICENSE MAY NOT SELL:

(I) ALCOHOLIC BEVERAGES FOR OFF-PREMISES CONSUMPTION;
OR

                 (II) AT ANY TIME EXCEPT IN CONJUNCTION WITH THE OPERATION

OF THE DINNER THEATRE.

[(4)](F) The license authorizes on-premises sales only. [;]

[(5)](G) The proposed premises location shall be:

[(i)] (1) Primarily within a mixed-use building or structure that
contains at least 250,000 total square feet of any combination of retail, service,
entertainment, PARKING, office, and restaurant uses; and

[(ii)](2) In the Old Towson Shopping District within the "Towson
Town Center", which district is located along both sides of the 300, 400, and 500 blocks of
York Road AND THE UNIT AND 100 BLOCKS OF EAST CHESAPEAKE AVENUE;

[(6)](H) The proposed premises location shall otherwise comply with the
zoning regulations [of Baltimore County];

[(7)] (I) The license, once issued, may not be:

[(i)] (1) Transferred to a new location outside the mixed-use building
or structure of original location issuance; or
