Ch. 66

1994 LAWS OF MARYLAND

(2) IN LIEU OF, OR IN ADDITION TO, ANY PENALTY PROVIDED IN THIS
ARTICLE, THE AUTHORITY MAY IMPOSE A PENALTY OF NOT MORE THAN $1,000 ON
ANY COMMISSION SELLING AGENCY THAT VIOLATES ITS DAILY SALES QUOTA
ALLOCATED BY THE AUTHORITY UNDER THIS SECTION A PENALTY OF:

(I)      FOR AN OVERAGE NOT EXCEEDING 10 PERCENT ON A SALE
DAY, .SUBTRACTION OF THE AMOUNT OF THE OVERAGE FROM THE COMMISSION
SELLING AGENCY'S SALES QUOTA OVER THE NEXT 2 SALE DAYS IN ORDER TO
CORRECT. THE OVERAGE, AND ANY OVERAGE ON THE CORRECTIVE SALE DAYS,
REGARDLESS OF AMOUNT, SHALL BE SUBJECT TO DOUBLING AND ADMINISTRATIVE
PENALTY UNDER ITEM (II) OF THIS PARAGRAPH; OR

(II)     FOR AN OVERAGE OF MORE THAN 10 PERCENT ON A SALE DAY,
OR FOR ANY OVERAGE DURING A CORRECTIVE SALE DAY UNDER ITEM (I) OF THIS
PARAGRAPH:

1. DOUBLE THE TOTAL AMOUNT OF THE OVERAGE, TO BE
SUBTRACTED FROM THE COMMISSION SELLING AGENCY'S SALES QUOTA AT A TIME
DETERMINED BY THE AUTHORITY; AND

2. AN ADMINISTRATIVE PENALTY OF $100 FOR EACH
PERCENTAGE POINT OF OVERAGE ABOVE 14 PERCENT, NOT TO EXCEED $1,000, TO BE
ASSESSED AND DUE AT A TIME AND IN A MANNER DETERMINED BY THE
AUTHORITY.

(3) ADMINISTRATIVE PENALTIES COLLECTED BY THE AUTHORITY
UNDER THIS SUBSECTION SHALL BE PAID INTO THE GENERAL FUND OF THE STATE.

(4) THE AUTHORITY SHALL ADOPT REGULATIONS NECESSARY TO
CARRY OUT THE PROVISIONS OF THIS SUBSECTION.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect
October 1, 1994.

FOR the purpose of permitting in Harford County a person to carry or sell alcoholic
beverages in any place in a bowling alley, including any portion of a restaurant
openly visible from th
e bowling lanes and concourse, at certain times; granting
additional privileges to certain alcoholic beverages licensees in Harford County by
authorizing the licensee to sell and to allow a customer to carry or consume
