AN ACT concerning
State Tobacco Authority - Civil Administrative Penalties and Quotas
FOR the purpose of authorizing the State Tobacco Authority to impose a civil an
administrative penalty on a commission sales agency that violates certain tobacco
quota restrictions under certain circumstances; specifying certain allocation
penalties for certain violations of certain tobacco quota restrictions; and generally
relating to the duties of the State Tobacco Authority.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

(b) The Authority shall determine and allocate annually among commission
selling agencies a daily sales quota and selling time, to limit the poundage of tobacco sold
during a market season to prevent disorderly market conditions.
(4) [If] SUBJECT TO SUBSECTION (C) OF THIS SECTION, IF a licensed
commission selling agency oversells its daily sales quota, the Authority may impose a
penalty on that agency by doubling the pounds of tobacco oversold and subtracting an
amount that does not exceed that amount from the sales quota on any day the quota is in
effect. In addition, the Authority may deduct an amount that does not exceed this amount
from an agency's average daily net sales during any market season.
(C) (1) THE AUTHORITY MAY IMPOSE A CIVIL AN ALLOCATION PENALTY
AND AN ADMINISTRATIVE PENALTY AS PROVIDED IN THIS SUBSECTION.
