SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect
October 1, 1994.

(House Bill 640)

AN ACT concerning

Control of Tuberculosis - Treatment of Infected Persons

FOR the purpose of authorizing a health officer to order an individual with tuberculosis
to receive appropriate medical care; provide for the placement of noncompliant
individuals into a restricted setting under certain circumstances; and generally
relating to the control of tuberculosis.

BY repealing and reenacting, with amendments,

Section 18-324 and 18-325
Annotated Code of Maryland
(1990 Replacement Volume and 1993 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article - Health - General

18-324.

(a)     A health officer may have an individual examined, if the health officer knows
or is notified in writing by a physician that the individual[:

(1)     Is suspected of having tuberculosis in a communicable stage; and

(2)     In a public place, is exposing other individuals to infection] IS
SUSPECTED OF HAVING TUBERCULOSIS.

(b)     (1) If, after the examination, the health officer finds that the individual has
tuberculosis [in a communicable stage,] AND THAT THE CONDITION OF THE
INDIVIDUAL ENDANGERS, OR MAY ENDANGER, THE PUBLIC HEALTH OF THE
COMMUNITY, the health officer may order the individual [to be taken to an appropriate
health facility until the condition of the individual no longer endangers the community
where the individual lives.] TO RECEIVE APPROPRIATE MEDICAL CARE.

(2) IF THE INDIVIDUAL FAILS TO COMPLY WITH THE ORDER, THE
HEALTH OFFICER MAY ORDER THE INDIVIDUAL TO BE PLACED IN ANY OF THE
FOLLOWING TYPES OF MEDICAL QUARANTINE IN ORDER TO PROTECT THE PUBLIC
