Higher Education Commission to make a recommendation to the Governor
regarding the establishment of a community college, thereby empowering the
Governor to appoint the college's board of trustees.

16-408.2.

(b) Competitive sealed proposals may be used if:

(3) The board [or] OF trustees or its designee determines that:

(i) The need to use a method other than competitive sealed bids is
sufficiently compelling to override the general public policy that favors awarding
procurement contracts on the basis of competitive sealed bids; and

(ii) The use of competitive sealed bidding for that procurement
contract is not practicable or not advantageous to the college.

(ii) Occupational therapist or an occupational therapist assistant who
has at least an Associate [of Arts] degree in occupational therapy;
