(a)     The budget for State Use Industries shall be included in the budget of the
Department of Public Safety and Correctional Services, and shall be subject to normal
legislative review and approval.

(b)     The number of its positions shall be included within the total manpower
allocations provided for the Department of Public Safety and Correctional Services.

(c)      [Except as provided in subsection (d) of this section or otherwise by law, its
positions are in the classified service of the State Personnel Management System.

(d)] The General Manager[:

(1)     Shall] SHALL be appointed by the Secretary of the Department, with
the approval of the State Use Industries Advisory Committee[; and

(2)     Is in the unclassified service of the State Personnel Management
System].

SECTION 2. AND BE IT FURTHER ENACTED, That if a filled position in the
State Use Industries is in the classified service on September 30, 1994, the position shall
remain in the classified service until it becomes vacant.

SECTION 3. AND BE IT FURTHER ENACTED, That the Secretary of Personnel
and the Secretary of Public Safety and Correctional Services jointly may establish a
revised incentive-based compensation plan for employees at the State Use Industries and
the Secretary of Public Safety and Correctional Services may submit the revised plan as
part of the budget request for fiscal year 1996. If approved as part of the budget, the
revised incentive-based compensation plan would replace the existing plan and continue
in effect until changed by law.

SECTION 4. AND BE IT FURTHER ENACTED, That this Act shall take effect
October 1, 1994.

(House Bill 90)

AN ACT concerning

YMCA of Cumberland Loan of 1993

FOR the purpose of amending Chapter 525 of the Acts of the General Assembly of 1993,
the YMCA of Cumberland Loan of 1993, to provide that the YMCA of Cumberland
rather than the Board of County Commissioners of Allegany County is the recipient
of the grant and that the YMCA of Cumberland must meet certain requirements
concerning matching funds; and making this Act an emergency measure.
