Article - Health - General

[Subtitle 4. Medical Test Units.]
[17-401.

(a)     In this subtitle the following words have the meanings indicated.

(b)     (1) "Medical test unit" means any mobile or other unit that offers to
provide, with or without charge, any physical or physiological examination to detect an
abnormality of the human body or any of its functions.

(2) "Medical test unit" includes a unit that offers these examinations in this
State, whether the examination is read or interpreted inside or outside of this State.

(c)     "Permit" means a permit issued by the Secretary to operate a medical test
unit.]

[17-402.

(a)     (1) In cooperation with the Medical and Chirurgical Faculty of the State of
Maryland, the Secretary shall adopt rules and regulations that set standards and
qualifications for medical test units.

(2) The rules and regulations shall contain standards and qualifications that
assure the citizens of this State that:

(i) Medical test units offer safe and reliable tests; and

(ii) Qualified staff properly perform and supervise each test.

(b)     To assure compliance with the standards and qualifications adopted under
this subtitle, the Secretary shall have an inspection made:

(1)     Of each medical test unit for which a permit is sought; and

(2)     Periodically of each medical test unit for which a permit has been
issued.]

[17-403,

The Secretary shall set reasonable fees for the issuance and renewal of permits.]

[17-404.

(a)     Except as otherwise provided in this subtitle, a person shall hold a permit
issued by the Secretary before the person may operate a medical test unit in this State.

(b)     This section does not apply to:

(1)     A health care practitioner who is licensed to practice a profession or
discipline in this State, while the practitioner performs tests on a patient of the
practitioner;

(2)     A hospital;
