(3) Unless otherwise provided by law, the Secretary shall appoint and
remove all other staff in the Office of the Secretary in accordance with the PROVISIONS
OF THE State PERSONNEL ARTICLE [Merit System Law] THAT GOVERN CLASSIFIED
SERVICE EMPLOYEES. .

(a) [The] EXCEPT AS OTHERWISE PROVIDED BY LAW, THE executive director
may employ a staff in accordance with the State budget AND THE PROVISIONS OF THE
STATE PERSONNEL ARTICLE THAT GOVERN CLASSIFIED SERVICE EMPLOYEES. '
(a) (1) The executive director may employ a staff in accordance with the State
budget.
(2) EXCEPT AS OTHERWISE PROVIDED BY LAW, THE STAFF IS IN THE
CLASSIFIED SERVICE OF THE STATE PERSONNEL MANAGEMENT SYSTEM.

(a) (2) The executive director IS IN THE UNCLASSIFIED SERVICE OF THE
STATE PERSONNEL MANAGEMENT SYSTEM AND serves at the pleasure of the
Secretary.

(a) With the approval of the Commission and EXCEPT AS OTHERWISE
PROVIDED BY LAW, subject to the [merit system], PROVISIONS OF THE STATE
PERSONNEL ARTICLE THAT GOVERN CLASSIFIED SERVICE. EMPLOYEES, the
Executive Director shall appoint a staff of the Commission.

(c) The Attorney General also shall appoint an assistant securities commissioner
who, after appointment, shall hold [his] THAT position subject generally to the
provisions of DIVISION I OF THE STATE PERSONNEL Article [64A of the Code]. If a
vacancy occurs in the position of assistant securities commissioner, the vacancy shall be
filled by a person appointed by the Attorney General subject to the provisions of
DIVISION I OF THE STATE PERSONNEL Article [64A of the Code]. Each person
appointed shall hold his position subject generally to [the] THOSE provisions [of Article
64A].
Article - Courts and Judicial Proceedings

(a) [Section 27, Article 64A of the Code] TITLE 6, SUBTITLE 1 OF THE STATE
PERSONNEL ARTICLE applies to judicial salaries, except for [its] THE provisions OF §
6-108(C) OF THE STATE PERSONNEL ARTICLE authorizing [emergency salary] PAY
increases with approval of the Board of Public Works.
