Article 24 - Political Subdivisions - Miscellaneous Provisions

TITLE 13. POLITICAL ACTIVITIES OF EMPLOYEES.
13-101. "LOCAL ENTITY" DEFINED.

IN THIS TITLE, "LOCAL ENTITY" MEANS:

(1)      A COUNTY;

(2)      A MUNICIPAL CORPORATION;

(3)      A BICOUNTY OR MULTICOUNTY AGENCY;

(4)      A COUNTY BOARD OF EDUCATION;

(5)      A PUBLIC AUTHORITY;

(6)     A SPECIAL TAXING DISTRICT; AND

(7)      ANY OTHER PUBLIC ENTITY WHOSE EMPLOYEES ARE NOT COVERED
BY TITLE 3, SUBTITLE 2 OF THE STATE PERSONNEL ARTICLE.

REVISOR'S NOTE: Chapter ______, Acts of 1993, which enacted Division I of the

State Personnel Article, also enacted this section.

Items (1), (2), (4), and (5) of this section are new language derived without
substantive change from the first clause of former Art. 33, § 28-1, as it
described local entities.

Items (3) and (6) of this section are substituted for the former reference to a
"body political" to conform to the similar list of entities in § 10-101 of this
article.

Item (7) of this section is new language added to ensure coverage of all public
employees who might not be considered State employees for purposes of the
counterpart provisions appearing in Title 3, Subtitle 2 of the State Personnel
Article.

This section is revised as a definition for clarity and brevity.

13-102. PUBLIC POLICY.

EMPLOYMENT BY A LOCAL ENTITY DOES NOT AFFECT ANY RIGHT OR
OBLIGATION OF A CITIZEN UNDER THE CONSTITUTION AND LAWS OF THE UNITED
STATES OF AMERICA OR UNDER THE CONSTITUTION AND LAWS OF THIS STATE.
