1993 LAWS OF MARYLAND

REVISOR'S NOTE: Chapter______, Acts of 1993, which enacted Division I of the

State Personnel Article, also amended subsection (a)(2) of this section to
incorporate former Art. 64A, § 3(5).

The limited reference in former Art. 64A, § 3(5) to "attorneys" is deleted as
unnecessary in light of the broad reference to all "[s]taff".

9-108.

(e) (1) With the advice of the Commission, the Director may employ deputy
directors and other staff in accordance with the State budget.

(2)     EXCEPT AS PROVIDED IN PARAGRAPH (3) OF THIS SUBSECTION OR
OTHERWISE BY LAW, THE STAFF OF THE COMMISSION IS IN THE CLASSIFIED
SERVICE OF THE STATE PERSONNEL MANAGEMENT SYSTEM.

(3)     A deputy director IS IN THE UNCLASSIFIED SERVICE OF THE STATE
PERSONNEL MANAGEMENT SYSTEM. HOWEVER, A DEPUTY DIRECTOR may be
removed ONLY for cause after [the deputy director is] BEING given[: (i)] notice[;] and
[(ii)] an opportunity for a hearing.

REVISOR'S NOTE: Chapter______, Acts of 1993, which enacted Division I of the

State Personnel Article, also amended subsection (e) of this section to
incorporate without substantive change former Art. 64A, § 9V(a) and (b)(1),
and to make stylistic changes.

In subsection (e)(2) of this section, the phrase "[e]xcept as provided ...
otherwise by law" is added to reflect other laws that may affect the status of
various employees. See, e.g., Title 1, Subtitle 4 of the State Personnel Article.

2-104.

(c) The State Supervisor of Assessments and the assessment area supervisors ARE
IN THE UNCLASSIFIED SERVICE OF THE STATE PERSONNEL MANAGEMENT SYSTEM.
HOWEVER THEY shall hold their positions during good behavior, and may be removed
from their positions only after a hearing before the Department, and a finding of
incompetency or other cause.                                                           

REVISOR'S NOTE: Chapter______, Acts of 1993, which enacted Division I of the

State Personnel Article, also amended subsection (c) of this section to
incorporate without substantive change former Art. 64A, § 4(10).

The references in former Art. 64A, § 4(10) to the "chief supervisor" and to
"assistant State supervisors" are deleted as obsolete and encompassed within
the positions identified in this subsection.

(b) (2) Each supervisor [shall]:
