8-112. SPECIAL ENROLLMENT PERIOD FOR CERTAIN EMPLOYEES.

(A)     IN GENERAL.

IN ADDITION TO REGULAR OPEN ENROLLMENT PERIODS, THE PROGRAM
SHALL PROVIDE SPECIAL OPEN ENROLLMENT FOR HEALTH INSURANCE BENEFIT
OPTIONS ESTABLISHED UNDER THE PROGRAM FOR A NONPARTICIPATING STATE
EMPLOYEE AFTER THE DEATH OF A SPOUSE WHO WAS NOT A STATE EMPLOYEE.

(B)     EVIDENCE OF INSURABILITY NOT REQUIRED.

EVIDENCE OF INSURABILITY MAY NOT BE REQUIRED UNDER THIS SECTION IF
THE STATE EMPLOYEE WAS COVERED UNDER A GROUP HEALTH INSURANCE
POLICY AT THE TIME OF THE DEATH OF THE EMPLOYEE'S SPOUSE.

REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 64A, § 48D.

In subsection (a) of this section, the phrase "after the death of a spouse" is
added for clarity.

Also in subsection (a) of this section, the introductory clause "[i]n addition to
regular open enrollment periods" and the reference to "special open
enrollment" are substituted for the former phrase "continuous open
enrollment" to clarify that limitations may be placed on the time within which
a surviving spouse may enroll. See COMAR 06.01.07.04.

In subsection (b) of this section, the phrase "covered ... at the time of the
death of the employee's spouse" is substituted for the former phrase
"previously covered" for clarity and specificity.

SUBTITLE 2. INCENTIVE AWARDS.

8-201. "PRINCIPAL UNIT" DEFINED.

IN THIS SUBTITLE, "PRINCIPAL UNIT" MEANS A PRINCIPAL DEPARTMENT OR
OTHER INDEPENDENT UNIT IN THE EXECUTIVE BRANCH OF STATE GOVERNMENT,
INCLUDING ANY UNIT WITH INDEPENDENT PAY-SETTING AUTHORITY.

REVISOR'S NOTE: This subsection formerly was Art. 64A, § 32A(a) and (c).

Because the word "unit" is used generically throughout this Division I to refer
to any type of agency, department, board, etc., the term "principal unit" is
substituted, as the defined term, to reflect the narrower scope of this
definition.

The only changes are in style.
