8-107. ENROLLMENT IN PROGRAM — STATE EMPLOYEES AND CERTAIN SURVIVORS.

(A)     CURRENT STATE EMPLOYEES.

SUBJECT TO THE REGULATIONS ADOPTED UNDER § 8-103 OF THIS SUBTITLE, A
STATE EMPLOYEE MAY ENROLL AND PARTICIPATE IN ANY OF THE HEALTH
INSURANCE OR OTHER BENEFIT OPTIONS ESTABLISHED UNDER THE PROGRAM.

(B)     SURVIVING SPOUSES.

THE SURVIVING SPOUSE OF A STATE EMPLOYEE WHO DIED WHILE EMPLOYED
BY THIS STATE MAY ENROLL AND PARTICIPATE IN THE HEALTH INSURANCE
BENEFIT OPTIONS ESTABLISHED UNDER THE PROGRAM AS LONG AS THE
SURVIVING SPOUSE IS RECEIVING AN ALLOWANCE UNDER ARTICLE 73B, § 2-417, §
3-414, § 4-414, § 5-413, § 6-411, § 7-410, § 8-408, OR § 9-104 OF THE CODE.

(C)     SURVIVING MINOR CHILDREN AND DEPENDENT PARENTS OF STATE
POLICE.

THE SURVIVING MINOR CHILD OR DEPENDENT PARENT OF A STATE POLICE
OFFICER WHO DIED WHILE EMPLOYED BY THIS STATE MAY ENROLL AND
PARTICIPATE IN THE HEALTH INSURANCE BENEFIT OPTIONS ESTABLISHED UNDER
THE PROGRAM AS LONG AS THE CHILD OR PARENT IS RECEIVING AN ALLOWANCE
UNDER ARTICLE 73B, § 6-411 OF THE CODE.

REVISOR'S NOTE: Subsections (a) and (b) of this section are new language
added to state expressly that a current State employee and the surviving
spouse of a deceased employee who receives an allowance may enroll in the
Program.

Subsection (c) of this section is new language derived without substantive
change from former Art. 64A, § 48(b) and § 48B(c)(2)(ii).

In subsection (a) of this section, the introductory language "[s]ubject to the
regulations adopted under § 8-103 of this subtitle" is added to reflect that
some employees, - e.g., temporary extra employees - are not eligible to enroll
in the Program, while other employees - e.g., certain contractual employees -
are eligible to enroll but are not eligible to receive State subsidies. See
COMAR 06.01.07.03.

In subsections (b) and (c) of this section and throughout this subtitle, the term
"health insurance" is substituted for the former reference to "hospital,
medical, and surgical insurance" for brevity and consistency.

In subsection (c) of this section, the reference to a "surviving minor child or
dependent parent" is substituted for the former reference in Art. 64A, §
48B(c)(2)(ii) to "[a] person in receipt of a special death benefit" for clarity.
