Subsection (b)(1) of this section is revised to define "off-duty hours" to avoid
repetition of a description of those hours.
In subsection (b)(1)(i) and (b)(2) of this section, the former reference to a law
enforcement officer's "regularly" scheduled off-duty day is deleted as
potentially misleading and, in any event, unnecessary given the requirement
that the off-duty time be "scheduled".
In subsection (b)(2) of this section, the phrase "[e]xcept as otherwise provided
in this subsection" is added to reflect the exceptions that exist for certain
officers.
In the introductory language of subsection (b)(3) of this section, the job titles
"Park Ranger Supervisor" and "Park Services Supervisor" are substituted for
the former reference to a "Park Ranger III" to reflect the current titles of
those positions in the Department of Natural Resources.
6-309. EMPLOYEES LIMITED TO COMPENSATORY TIME.
(A) DESIGNATED EMPLOYEES.
THE SECRETARY MAY DESIGNATE THOSE BONA FIDE ADMINISTRATIVE,
EXECUTIVE, AND PROFESSIONAL EMPLOYEES WHO MAY NOT RECEIVE PAYMENT
FOR OVERTIME WORK, BUT WHO MAY BE GRANTED COMPENSATORY TIME FOR
OVERTIME WORK.
(B) CERTAIN EMPLOYEES IN EXECUTIVE PAY PLAN.
ON OR AFTER JULY 1, 1989, AN EMPLOYEE WHO IS INCLUDED IN THE
EXECUTIVE PAY PLAN AT A PAY GRADE OF (ES) 6 OR ABOVE IS NOT ENTITLED TO
ACCRUE ANY COMPENSATORY TIME OTHER THAN AS PROVIDED IN § 7-206 OF THIS
ARTICLE.
(C) CERTAIN OFFICERS OF MARYLAND STATE POLICE AND DEPARTMENT OF
NATURAL RESOURCES POLICE.
A LAW ENFORCEMENT EMPLOYEE OF THE MARYLAND STATE POLICE
HOLDING A COMMISSIONED RANK OR A LAW ENFORCEMENT EMPLOYEE OF THE
DEPARTMENT OF NATURAL RESOURCES HOLDING A RANK ABOVE SERGEANT,
ABOVE PARK RANGER SUPERVISOR, OR ABOVE PARK SERVICES SUPERVISOR MAY
NOT RECEIVE PAYMENT FOR ANY OVERTIME WORK, BUT MAY BE GRANTED
COMPENSATORY TIME FOR OVERTIME WORK IN EXCESS OF 30 OVERTIME HOURS IN
A FISCAL YEAR.
REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 64A, § 27(a)(2)(x), as it limited accruals of
compensatory time for certain employees, and from the first sentence of
former Art. 89, § 27(c), the second sentence of § 27(e)(3), and the second
sentence of § 27(e)(5).
