Ch. 10

THERE IS A STANDARD PAY PLAN AND AN EXECUTIVE PAY PLAN FOR THIS
STATE, AS ESTABLISHED BY THE SECRETARY WITH THE APPROVAL OF THE
GOVERNOR AND AS AMENDED OR ADJUSTED IN ACCORDANCE WITH THIS
SUBTITLE.

(B)  PURPOSE OF PAY PLANS.

THE PURPOSE OF THE PAY PLANS IS TO PROVIDE EMPLOYEES IN POSITIONS
THAT INVOLVE COMPARABLE EFFORT, KNOWLEDGE, RESPONSIBILITIES, SKILLS,
AND WORKING CONDITIONS WITH COMPARABLE PAY ACCORDING TO THE
RELATIVE VALUE OF SERVICES TO BE PERFORMED.

(C)     PAY PLANS SUBJECT TO BUDGET.

A PAY PLAN IS EFFECTIVE FOR A FISCAL YEAR ONLY TO THE EXTENT THAT
SUFFICIENT MONEY IS AVAILABLE IN THE STATE BUDGET FOR THAT PURPOSE.

REVISOR'S NOTE: This section is new language derived without substantive
change from the first sentence of former Art. 64A, § 27(a)(2)(i), § 27(a)(1)(iii)
and, except as it related to positions in the plan, § 27(a)(1)(i).

Subsection (a) of this section is restated to reflect that the plans already have
been established, though subject to periodic change in accordance with this
subtitle.

In subsection (a) of this section and throughout this subtitle, the reference to
the "Standard Pay Plan" is used to distinguish that plan from the "Executive
Pay Plan".

In subsection (c) of this section, the reference to a "fiscal year" is added for
clarity.

Also in subsection (c) of this section, the phrase "only to the extent that" is
substituted for "when" for clarity.

6-102. SCOPE OF PAY PLANS.

(A) IN GENERAL.

(1) EXCEPT AS PROVIDED IN PARAGRAPH (2) OF THIS SUBSECTION, THE
PAY PLANS ESTABLISHED UNDER THIS SUBTITLE SHALL INCLUDE:

(I)      ALL CLASSIFIED SERVICE AND UNCLASSIFIED SERVICE
POSITIONS IN THE EXECUTIVE BRANCH OF STATE GOVERNMENT;

(II)     ALL CLASSIFIED SERVICE POSITIONS IN THE DISTRICT COURT
OF MARYLAND; AND

(III)   ALL OTHER POSITIONS FOR WHICH THE SECRETARY HAS
AUTHORITY TO ADMINISTER PAY.
