5-106. DUTIES OF SECRETARY AND DEPARTMENT.

(A)     ADMINISTRATION BY DEPARTMENT.

THE DEPARTMENT SHALL ADMINISTER THIS TITLE IN SUBSTANTIAL
COMPLIANCE WITH THE STANDARDS OF THE EMPLOYMENT STANDARDS
ADMINISTRATION OF THE UNITED STATES DEPARTMENT OF LABOR.

(B)     REGULATIONS BY SECRETARY.

THE SECRETARY SHALL ADOPT REGULATIONS TO CARRY OUT THIS TITLE.

(C)     PROMOTION OF PART-TIME EMPLOYMENT.

(1)      THE DEPARTMENT SHALL CONSIDER THE WELFARE OF EMPLOYEES
IN EACH UNIT OF STATE GOVERNMENT THAT IS SUBJECT TO THIS TITLE.

(2)      THE DEPARTMENT SHALL:

(I)      CONDUCT RESEARCH AND EXPERIMENTATION PROJECTS AND
ANY OTHER ACTIVITIES DESIGNED TO ADVANCE OPPORTUNITIES FOR PART-TIME
EMPLOYMENT IN THE PUBLIC SECTOR;

(II)     ENCOURAGE ALL PUBLIC EMPLOYERS TO ADOPT PART-TIME
EMPLOYMENT PRACTICES; AND

(III)   PROMOTE AND SUPERVISE PROGRAMS FOR PART-TIME
EMPLOYMENT IN UNITS IN THE EXECUTIVE BRANCH OF STATE GOVERNMENT.

REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 64A, § 51(f) and (g) and, as it related to regulations
about "filling ... any one full-time position by two or more part-time
employees", § 37A(a).

In subsection (c) of this section, the term "Department" is substituted for the
former references to the "Secretary" and the Secretary's "designee" to
conform to subsection (a) of this section, which requires the Department to
"administer this title".
