1993 LAWS OF MARYLAND

In subsection (b)(1) of this section, the reference to "the reason for the
proposed disqualification" is added to clarify the contents of the notice,
consistent with similar provisions elsewhere. See §§ 4-204 and 4-303 of this
title.

In subsection (b)(2) of this section, the former phrase "explaining why the
person's name should not be removed from the eligible list" is deleted as
unnecessary in light of the use of the broad term "response".

The State Personnel Article Review Committee notes, for consideration by
the General Assembly, that the grounds listed under subsection (a) of this
section differ from the grounds listed in other similar sections in this title. See
§§ 4-204, 4-303, and 4-307 of this title and their respective Revisor's Notes.

As to disqualifications for medical reasons, see § 3-501 of this article.

SUBTITLE 3. CERTIFICATION AND APPOINTMENT.

4-301. REQUESTS FOR CERTIFICATION.

(A)     IN GENERAL..                 .

EXCEPT AS OTHERWISE PROVIDED IN THIS DIVISION I, TO FILL A VACANCY IN
ANY POSITION IN THE CLASSIFIED SERVICE, THE APPOINTING AUTHORITY SHALL
REQUEST THE SECRETARY TO CERTIFY A LIST OF ELIGIBLE CANDIDATES FOR THE
POSITION.

(B)     SELECTIVE CERTIFICATION.

(1)      THE APPOINTING AUTHORITY MAY REQUEST FROM THE
SECRETARY A SELECTIVE CERTIFICATION OF ELIGIBLE CANDIDATES FOR A
SPECIFIC GEOGRAPHIC AREA OR WITH SPECIFIC JOB-RELATED QUALIFICATIONS.

(2)      A REQUEST FOR SELECTIVE CERTIFICATION SHALL:

(I)      BE IN WRITING; .

(II)     STATE THE REASONS FOR THE REQUEST, INCLUDING ANY
DUTIES OF THE POSITION THAT REQUIRE SPECIFIC JOB-RELATED QUALIFICATIONS;
AND

(III)   CERTIFY THAT THE REQUEST IS NOT BASED ON ANY FACTOR
PROHIBITED BY § 3-405 OF THIS ARTICLE.

(3)      THE SECRETARY MAY APPROVE OR DISAPPROVE ANY REQUEST
FOR SELECTIVE CERTIFICATION.

REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 64A, § 1(3), § 17(d)(2), the first through third
sentences of § 17(d)(1), and the first sentence of § 17(a).
