3-403. PROGRAM ESTABLISHED; PURPOSE.

(A)     PROGRAM ESTABLISHED.

THERE IS AN EQUAL EMPLOYMENT OPPORTUNITY PROGRAM, WHICH IS
UNDER THE AUTHORITY OF THE SECRETARY.

(B)      PURPOSE.

THE PURPOSE OF THE PROGRAM IS TO ENSURE A SYSTEM BASED ON MERIT
THAT PROVIDES EQUAL OPPORTUNITY IN EMPLOYMENT ON THE BASIS OF MERIT
AND FITNESS.

REVISOR'S NOTE: This section is new language derived without substantive
change from the first sentence of former Art. 64A, § 12A.

In subsection (a) of this section, the reference to the Secretary's "authority" is
substituted for "auspices" for clarity.

3-404. DUTIES OF SECRETARY.

(A)     IN GENERAL.

THE SECRETARY SHALL:

(1)      DEVELOP THE PROGRAM; AND

(2)      ADOPT AND ENFORCE REGULATIONS TO IMPLEMENT THE
PROGRAM.

(B)      COMPLIANCE WITH OTHER LAWS.

THE REGULATIONS ADOPTED UNDER THIS SECTION SHALL COMPLY WITH ALL
APPLICABLE STATE AND FEDERAL LAWS GOVERNING EQUAL EMPLOYMENT
OPPORTUNITY.

REVISOR'S NOTE: This section is new language derived without substantive
change from the first through third sentences of former Art. 64A, § 12B.

The former reference to the "overall administration of the ... program" is
deleted as unnecessary in light of the general administrative responsibilities of
the Secretary. See § 2-103 of this article.

The former references to "rules" and "guidelines" are deleted as included in
the reference to "regulations". See General Revisor's Note to this Division I.
