1993 LAWS OF MARYLAND

(I)      HELPING TO TEST CANDIDATES FOR POSITIONS;

(II)     HELPING TO PREPARE REGULATIONS; AND

(III) MAKING AVAILABLE THE FULL USE OF THE FACILITIES OF THE
DEPARTMENT.

(C) CHARGE FOR ASSISTANCE.

(1)      EXCEPT AS PROVIDED IN PARAGRAPH (2) OF THIS SUBSECTION, THE
DEPARTMENT SHALL PROVIDE THE ASSISTANCE REQUIRED BY THIS SECTION
WITHOUT CHARGE.

(2)      A COUNTY OR MUNICIPAL CORPORATION SHALL REIMBURSE THE
DEPARTMENT FOR TRAVEL AND OTHER EXPENSES THAT THE DEPARTMENT INCURS
BECAUSE OF THE USE OF DEPARTMENTAL FACILITIES BY THAT COUNTY OR
MUNICIPAL CORPORATION.

REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 64A, § 47A(a) and the second sentence of § 47A(b).

Throughout this section, the term "Department" is substituted for the former
reference to "Secretary" because the duties under this section are
departmental in nature and not personal duties of the Secretary. However, the
requirement that a local government make its request "to the Secretary" is
retained.

In subsection (a) of this section, the former reference to a local merit system
adopted under "the Constitution of this State, Article XI-A and the Act of
1918, Chapter 456, § 5-R or otherwise" is deleted as surplusage.

The first sentence of former Art. 64A, § 47A(b), which required the Secretary
to provide assistance on request of a judge of a circuit court who wanted help
in testing the fitness of a candidate for deputy clerk, is deleted as obsolete.
Candidates for deputy clerk are selected according to the personnel system
established by the Chief Court Administrator. See Md. Rule 1212.

2-205. ASSISTANCE TO DEPARTMENT.

(A)     BY STATE PERSONNEL.

ON REQUEST OF THE SECRETARY, ALL EMPLOYEES AND OFFICERS OF THIS
STATE SHALL ASSIST THE DEPARTMENT IN ALL PROPER WAYS IN CARRYING OUT
THIS DIVISION I AND THE REGULATIONS ADOPTED UNDER IT. THIS ASSISTANCE
SHALL BE PROVIDED AS A PUBLIC DUTY AND WITHOUT EXTRA COMPENSATION.

(B)     BY STATE AND LOCAL PERSONNEL.
