Also in subsection (d) of this section, the former phrase "in the Maryland
State service" is deleted to avoid the unintended implication that positions in
all branches of State government are subject to this procedure.

In subsection (e)(1) of this section, the words "classified improperly" are
substituted for the former references to "underclassified" and
"overclassified" for brevity.

The State Personnel Article Review Committee notes, for consideration by
the General Assembly, that the Secretary conducts "desk" audits and
"classification" audits to ascertain whether classifications are proper. Because
the audits have the same result and effect, the General Assembly may wish to
add a reference to "other" audits in subsection (d) of this section.

2-108. REVIEWS AND RECOMMENDATIONS.

FOR EFFICIENCY AND ECONOMY IN STATE GOVERNMENT, THE SECRETARY
SHALL:

(1)      CONDUCT REVIEWS OF POSITIONS IN THE STATE PERSONNEL
MANAGEMENT SYSTEM; AND

(2)       RECOMMEND TO THE APPOINTING AUTHORITY A PLAN OF
REORGANIZATION, REASSIGNMENT, OR ELIMINATION OF THE POSITIONS
REVIEWED.

REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 64A, § 15B.

The reference to positions in the "State Personnel Management System" is
substituted for the former reference to positions in "State government" for
clarity and specificity, conforming to Departmental understanding.

The phrase "shall ... conduct reviews" is substituted for the former phrase
"directed ... to review" to clarify the authority of the Secretary to delegate that
function, subject to the Secretary's oversight.
