(4) A TEMPORARY PENDING EMPLOYEE.

REVISOR'S NOTE: This section is new language added for clarity in accordance
with long-standing Departmental understanding and administrative practice.

As to temporary pending employees, who are subject to certain provisions
contained in Title 4 of this article (i.e., § 4-306) but are not ordinarily
considered to be classified service employees, see Small v. Secretary of
Personnel, 267 Md. 532, 536 (1973).

Defined terms: "Classified service" § 1-101
"Contractual employee" § 1-101
"Unclassified service" § 1-101

GENERAL REVISOR'S NOTE TO TITLE:

The first clause of former Art. 64A, § 44, which provided a short title for Art. 64A,
is deleted as unnecessary in light of the organization of this revision.

Former Art. 64A, § 45, which provided for the severability of invalid provisions, is
deleted as unnecessary in light of Art. 1, § 23 of the Code.

Former Art. 64A, § 46, which provided for the repeal of laws inconsistent with the
provisions of former Art. 64A, especially those provisions governing "classification,
selection and appointment of employees, including Chapter 224 of the Acts of the
General Assembly of 1918", is deleted as obsolete.

As to the effect of this revision on the status of existing positions, see Sections 12
and 13 of Ch.____ (S.B. 50), Acts of 1993, which enacted this Division I.

SUBTITLE 1. GENERAL PROVISIONS.

2-101. DEPARTMENT ESTABLISHED.

THERE IS A DEPARTMENT OF PERSONNEL, WHICH IS A PRINCIPAL
DEPARTMENT OF THE STATE GOVERNMENT.

REVISOR'S NOTE: This section is new language derived without substantive
change from the first sentence of former Art. 41, § 9-101(a).

It is set forth as a separate section for emphasis.

See also SG § 8-201(b), which lists the principal departments of the executive
branch of State government.

2-102. SECRETARY OF PERSONNEL.

(A) POSITION AND APPOINTMENT.

THE HEAD OF THE DEPARTMENT IS THE SECRETARY OF PERSONNEL, WHO
SHALL BE APPOINTED BY THE GOVERNOR WITH THE ADVICE AND CONSENT OF THE
SENATE.
