1-406. OTHER POSITIONS.

THE UNCLASSIFIED SERVICE INCLUDES ANY OTHER POSITION THAT IS
SPECIFIED BY LAW TO BE IN THE UNCLASSIFIED SERVICE.

REVISOR'S NOTE: This section is new language added to reflect other laws that
include in the unclassified service various State employees or that might
provide for the inclusion in the unclassified service of other employees who
might not be ordinarily considered part of the executive branch of State
government.

GENERAL REVISOR'S NOTE:

As originally enacted, former Art. 64A specified various positions that were
excluded from the classified service. Over the years, however, an accurate and complete
enumeration of excluded positions has not been maintained in Art. 64A, and numerous
laws elsewhere in the Code and Session Laws exempt positions from the classified service.
Accordingly, the State Personnel Article Review Committee decided against including a
comprehensive list of unclassified service positions in this article. Instead, the Committee
believes that it is more appropriate to provide unclassified service status for specific
positions of a unit in the law governing that unit.

Former Art. 64A, § 2, as it excluded from the classified service wardens,
superintendents, deputy wardens, assistant superintendents, consulting physicians, and
chaplains in several institutions now in the Department of Public Safety and Correction,
and § 4(3) and (7), which excluded from the classified service some identical positions as
well as assistant wardens and deputy assistant wardens at the Maryland House of
Correction and the Maryland Penitentiary, are revised in Art. 27, § 684 of the Code.

Former Art. 64A, § 3(4), which excluded from the classified service county
supervisors of assessments, is revised in TP § 2-105.

Former Art. 64A, § 3(5), which excluded from the classified service attorneys in or
connected with the Office of the Attorney General, is revised in SG § 6-105.

Former Art. 64A, §§ 3(6) and 4(8), which excluded from the classified service the
general counsel and assistant general counsels to the Public Service Commission and the
shorthand reporter of the Commission, respectively, are revised in Art. 78, § 17 of the
Code.

Former Art. 64A, § 3(7), which excluded from the classified service the general
counsel and assistant general counsels to the Human Relations Commission, is revised in
Art. 49B, § 2 of the Code. .
