1-303. OTHER POSITIONS.

THE CLASSIFIED SERVICE INCLUDES ANY OTHER POSITION THAT IS SPECIFIED
BY LAW TO BE IN THE CLASSIFIED SERVICE.

REVISOR'S NOTE: This section is new language added to reflect other laws that
might provide for the inclusion in the classified service of certain employees
who might not ordinarily be considered part of the executive branch of State
government.

Defined terms: "Classified service" § 1-101
"Position" § 1-101

SUBTITLE 4. UNCLASSIFIED SERVICE.

1-401. DIRECT APPOINTEES OF GOVERNOR OR BOARD OF PUBLIC WORKS.

EXCEPT AS OTHERWISE PROVIDED BY LAW, THE FOLLOWING POSITIONS IN
THE EXECUTIVE BRANCH OF STATE GOVERNMENT ARE IN THE UNCLASSIFIED
SERVICE:

(1)      A POSITION TO WHICH AN INDIVIDUAL IS DIRECTLY APPOINTED BY
THE GOVERNOR BY AN APPOINTMENT THAT IS NOT PROVIDED FOR BY THE
MARYLAND CONSTITUTION; AND

(2)      A POSITION TO WHICH AN INDIVIDUAL IS DIRECTLY APPOINTED BY
THE BOARD OF PUBLIC WORKS.

REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 64A, § 3(8).

In this section and throughout this subtitle, references to the "executive
branch" of State government are added for clarity.

The phrase "[e]xcept as otherwise provided by law" is added to reflect the
possibility of exceptions established by other laws.

The phrase "by an appointment that is not provided for by the Maryland
Constitution" is added to exclude appointees who are appointed under the
Maryland Constitution and are, therefore, excluded generally from the State
Personnel Management System. See § 1-202 of this article.

The former exception for the Motor Vehicle Administrator is deleted because
the Motor Vehicle Administrator is not directly appointed by the Governor or
the Board of Public Works. Appointment to that position is made by the
Secretary of Transportation, with approval of the Governor. See TR § 12-102.
